INTRODUCTION:

 

The Board of Directors of the Double Diamond Property Owners Association has adopted the following rules pertaining to the use of the Common Facilities within the Double Diamond Estates.

 

The primary consideration in the adoption of the Rules and regulations has been to enable any member in good standing and their guests to obtain maximum enjoyment from the use of the facilities, while at the same time considering the health, safety and general welfare of the members and their guests in the use thereof. These Rules and regulations are subject to change by the Board of directors of the Association pursuant to the By-Laws of the Association. The Board reserves the right to make changes at any time without prior notice.

 

The Association requests that the members make every effort to comply and cause members of their family and guests to comply with these rules. Only members in good standing will be allowed use of Common Facilities, unless otherwise approved by the Board of Directors and Manager.

 

The Directors, Officers and Employees of the Association shall at all times have the authority to see that each of these rules is carried out and to enforce same by suspension or revocation of the privilege of use.

DOUBLE DIAMOND PROPERTY OWNERS ASSOCIATION

RULES AND REGULATIONS

 

Article 1 – BASIC INFORMATION

 

Section 1.1 - Association

The Double Diamond Property Owners Association, Inc. (Association) is a private membership Association incorporated under the Texas Non-Profit Corporation Act and is operated under the provisions of this Act, the Association’s Restrictive Covenants, Bylaws and Court Rulings as well as Policies, Procedures and Rules approved by the Board of Directors. Lot owners are automatically members of the Association.

Section 1.2 - Board of Directors

An elected, five member Board of Directors governs the Association. The board along with a secretary/treasurer conducts the community’s daily affairs in accordance with the Association’s Restrictive Covenants and Bylaws as well as the Policies, Procedures and Rules approved by the Board of Directors.

Section 1.3 - Utilities

Xcel Energy provides electric service.  Windstream is the primary provider of land line phone service.  The City of Fritch supplies water service. Cable TV and high-speed internet services are also available in most units.  Natural gas is provided by Atmos Energy.  Propane is also available in the area.

Section 1.4 - Refuse

Trash service is provided by Allied Waste Inc. with the trash bins located on Club Drive just south of the pool for bagged or boxed household trash, garbage, lawn clippings and leaves.  Fees for the trash service are collected monthly on the City of Fritch water bill.  Items that do not fit in the trash dumpster with lid closed should be carried to the City of Fritch Recycling Center.  This is the only trash service allowed in Double Diamond.

 

Article 2 – Responsibilities

 

Section 2.1 - Compliance and Maintenance

Individual members, their family and guests are responsible for compliance with the Association’s Restrictive Covenants, Bylaws, Policies, Procedures and Rules. Members are also responsible for proper maintenance of their lot(s) and improvements thereon as well as prompt payment of amounts due the Association.

 

Section 2.2 - Actions of Guests

Members are responsible for the actions of their guests.

 

Section 2.3 - Risk and Loss

Members and guests use Association property at their own risk. The Association shall not be responsible for any loss or damage to personal property or for personal injury while using Association facilities.

 

Article 3 – policies and procedures

 

Section 3.1 - General

 

3.1.1 Use of Common Facilities

The Association shall not be responsible to anyone for personal injury or personal property damage while using the common facilities. Members and guests use the common property at their own risk and must use the facilities solely for their designated purposes. All Association facilities are generally available on a “first come, first served” basis unless specifically reserved.

 

3.1.2 Facility Use

1.  The Clubhouse may be reserved in advance by the members of the Association.  A rental and deposit fee will be required and paid in advance.  The Board may adopt and use such reservations forms and fees as it deems reasonable.  The “host member” shall assume full responsibility for any and all property damages occurring during the reservation time.  Any and all activities within the Clubhouse shall cease and terminate at 12:00 A.M.  Attendance at any member sponsored party or affair within the Clubhouse shall not exceed eighty (80) individuals.  No minor children of any member(s) shall use the Clubhouse facilities unless accompanied by an adult member. 

2.  Guests are not permitted to use Association facilities unless accompanied by a member except as otherwise provided by these rules. The member shall be responsible for the conduct of their guests and to see that all rules and regulations are observed by their guests.

3.  The swimming pool will be open during the summer months for use by members in good standing.  All swimmers are subject to posted rules and lifeguard authority.  The swimming pool may be reserved after normal hours using a Double Diamond approved lifeguard.

 

 

 

 

 

 

 

Section 3.2 - Home and Building Construction

 

3.2.1 Building Restrictions

A member planning to build should review the DDPOA Restrictive Covenants.  Copies of the Restrictive Covenants are available at the Association office and at the DDPOA website - www.ddpoa.webs.com.

 

3.2.2 Approval of Construction of Structures and Improvements

The Architectural Control Committee must approve all construction and exterior improvements before beginning any work including dirt work. Architectural regulations and guidelines have been established in the best interest of all property owners and to insure a degree of uniformity.  No building, fence or other structures or improvements shall be erected, placed or altered on any DDPOA lot until (i) two (2) copies of the construction plans and specifications, including, but not limited to, specifications of all exterior materials, including color of paint or stain, and (ii) a plan showing the proposed location of the structure shall have been submitted to and approved in writing by the Architectural Control Committee.  If construction is not commenced within eight (8) months after such approval, approval shall be null and void, unless an extension is granted in writing by the Architectural Control Committee.

 

3.2.3 Land Survey

An official land survey is required prior to any improvements being constructed on the lot and prior to any dirt work on a lot.  The surveyor's stakes must remain visible throughout construction.

 

Article 4 – rules

Section 4.1 - Objectives

The primary consideration in the adoption of the Rules and Regulations has been to enable any member in good standing and their guests to obtain maximum enjoyment from the use of the facilities, while at the same time considering the health, safety and general welfare of the member and their guests in the use thereof. These Rules and Regulations are subject to change by the Board of Directors of the Association pursuant to the By-Laws of the Association.  The Board reserves the right to make changes at any time without prior notice. 

All persons on Association property are required to abide by these rules. However, these rules do not preclude the Board of Directors or any Texas Law Enforcement Officer acting in an official capacity from taking whatever action is necessary to protect life and property. The Articles of Incorporation, Restrictive Covenants and Bylaws take precedence over these Rules.

Only members in good standing will be allowed use of DDPOA’s Common Facilities, unless otherwise approved by the Board of Directors.

Section 4.2 - Rules Administration and Citations for Rule Violation

4.2.1 Authority to Issue a Citation

Citations may be issued by the Board of Directors. In addition, any individual member who witnesses a rule violation may sign a complaint against the offender. The Board shall have full discretion in evaluating the complaint and, when justified, issue the appropriate citation.

 

4.2.2 Time Period

Citations are issued to the responsible member at the time the violation is observed, if practical. If the violation does not require investigation, citations will normally be mailed or hand delivered within 72 hours.

 

4.2.3 Fines and Suspension of Privileges Due to Citations

The DDPOA Board of Directors shall have the authority and power to distribute copies of these Rules and Regulations, and shall have the authority and power to take lawful and reasonable action to enforce compliance and observance of these Rules and Regulations, including by not limited to assigning fines and/or suspending use of common facilities for violations of rules and regulations.

 

Section 4.3 - Rules

4.3.1 Common Facilities

1.    Only members in good standing may use the common facilities.

2.    Under no circumstances will minors, as defined by Texas law, be served or allowed to consume liquor in or on any part of the Association’s property.

3.    Trash receptacles are provided at the clubhouse and swimming pool for disposition of refuse arising from the normal use of these facilities.  Each adult member shall be fully responsible for the proper care and clean-up of any or all facilities used by the member’s family and guests.

4.    Members will at all times be fully responsible for the conduct of children while using the Association’s common facilities.

4.3.2 Pets, Animals

1.    No animal, livestock or poultry of any kind shall be raised, bred or kept on any lot or plot within the DDPOA, except for dogs, cats or other household pets, provided such dogs, cats or household pets are not raised, bred or kept for commercial purposes. 

2.    Pets are to be kept on a leash at all times unless otherwise confined on the appropriate owner’s property.

3.    Any animal not controlled by a leash, chain or fence will be removed from the area at the owner’s expense, unless the animal in question is on the owners’ property.

4.    Except those animals trained for assistance to handicapped persons, pets are prohibited in the Clubhouse and the swimming pool.

5.    Owners are responsible to insure their pets are not an annoyance or nuisance to the neighborhood.

6.    A vicious animal is defined as any animal that attacks or that is known to have attacked an individual or another pet without provocation. It is a major violation if such an animal is loose and attacks or threatens to attack an individual or other animal.  All vicious animals must be kept in a fenced area or structure that is locked; capable of preventing the escape of the animal; preventing entry by the general public and clearly marked as containing a vicious animal. Any property owner that allows a vicious animal to escape its enclosure or run loose is subject to DDPOA penalties in addition to any Texas criminal penalty issued by Moore or Hutchinson County officials.

4.3.3 Disturbing the Peace, Disorderly Conduct

1.    Any activity, such as loud or offensive noises, boisterous or raucous conversation, or offensive music that disturbs the peace and serenity of the neighborhood is prohibited.

2.    Abusive, indecent, profane or vulgar language or conduct which tends to incite a breach of the peace is prohibited.

3.    Radio, television and other electronic sound devices are to be kept at a volume not to disturb others.  Public address systems are not permitted.

4.    Hunting of any kind with any kind of weapon is not permitted in DDPOA. 

5.    Peddling is not allowed in DDPOA.

6.    Firearms may be not discharged in DDPOA (exception for killing of varmints such skunks or rattlesnakes, only on one's own property).

 

4.3.4 Travel within DDPOA

1.    The speed limit on all DDPOA roads is 25 MPH unless otherwise posted.

2.    All travel and access within DDPOA shall be limited to the subdivision roads on the subdivision plats.  All “off road” driving of any kind is strictly prohibited. (Exception:  Operation of an OHV on private property within DDPOA is allowed ONLY for the purposes of loading, unloading, cleaning or placing OHV in its storage location.)

3.    Licensed motor vehicles only will be permitted on the streets and roads within the Development.  All streets and roads owned by Moore and Hutchinson Counties will be subject to their laws and control.  Violators will be reported to the respective county officials.

 

4.3.5 Architectural Control

1.    Refer to DDPOA Restrictive Covenants for complete restrictions.

2.    Units 1, 8 & 8A:  Homes that are constructed “on-site” only.  1800 sq ft minimum floor plan, exclusive of porches, stoops, open or closed carports, patios or garages.  No manufactured or modular homes.

3.    Units 2, 5, 6, & 7:  Manufactured and modular homes allowed.  900 sq ft minimum floor plan, exclusive of porches, stoops, open or closed carports, patios or garages.  Units 3 and 4 are camper lots.

4.    Manufactured or modular homes must be new and HUD approved.

5.    All new or replaced septic systems must comply with regulations within the County in which the lot lies and the Texas Administrative Code, Title 30, Chapter 285.

6.    One dwelling per two lots shall be permitted within Double Diamond Estates.  (Necessary for proper septic system installation.)

7.    No apartment buildings.

8.    Prior to begin construction, remodeling or moving a manufactured or modular home, all plans must be approved by the DDPOA Architectural Control Committee.

9.    No DDPOA lot shall be re-subdivided.

10. No Rental Property Allowed in DDPOA.  “Lease to Own” agreements allowed in Units 2, 3,4,5,6 & 7 only. “Lease to Own” agreements must be filed with the DDPOA Board of Directors.  All DDPOA privileges remain with the owner.  Lessee may purchase a common facility use membership at price set by Board of Directors, but lessee will not have voting privileges.

11. No retail or commercial business shall be conducted on any lot within Double Diamond Estates. 

12. No open flame outdoor burning of any kind at any time in DDPOA.

13. No Member shall maintain an accumulation of junk metals and/or junk automobiles for longer than three months without removing it from DDPOA.

14. No Member shall allow weeds, rubbish, brush, junk automobiles or parts thereof, scrap metal, scrap lumber, dilapidated buildings, or any other unsightly objectionable or unsanitary matter to accumulate or grow on any property within the DDPOA.  Undeveloped lots with native plants do not need to be cleared or mowed until time of development.
